Contracts of Employment

The contract of employment sets the foundation for the Employment Relationship.

The contract must contain legal minimums, and may set out the company's expectations of the employee's behaviours during their employment. Within the contract of employment, both the employee and the employer are obligated to the duty of mutual trust and confidence and to make only lawful and reasonable demands on each other. Every employee is under the obligation to carry out assigned duties, or the employer's instructions to the best of his or her abilities.

Settlement Agreements

Settlement Agreements

A Settlement Agreement is a legally binding contract between employer and employee. It settles claims that an employee may have against their employer.

A Settlement Agreement is usually used when ending the employment relationship, but it doesn’t have to be. A Settlement Agreement could also be used where the employment is ongoing, but both the employer and the employee want to settle a dispute which has arisen between them.

An employee handbook, or staff handbook, is a great way to engage new and current employees within a business with engaging information and setting expectations on their behaviours in the workplace.

Employee handbooks can help employers to prove that they have acted fairly and in accordance with set policies and procedures and more importantly inform employees of the behaviour you expect from them during their employment. The handbook would also detail any remedial action the company will take should employees behaviour fall short of the required standard. TUPE Consultation

Should you be considering purchasing or acquiring a business or a service provision change, you must be mindful that such business activities fall within TUPE the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE).

This means that your company will acquire the employees affected by the transfer, purchase or acquisition. It is essential that you carry out detailed and thorough employers due diligence to give you a full understanding of the transferring employees, for example pay and benefits, holiday entitlement, contracted days and hours.
